DEFINITIONS AND INTERPRETATION In these Terms and Conditions, unless the context indicates otherwise, the following words and expressions bear the meanings assigned to them below: "Act" - The Lotteries Act 57 of 1997, as amended from time to time, together with all regulations promulgated thereunder. "Beneficiary" - Hout Bay United Football Community, a registered non-profit organisation (NPO #165406), registered with the National Lotteries Commission under registration number 00268/01. "Commission" or "NLC" - The National Lotteries Commission, established in terms of section 2 of the Act. "Competition" - The Step-Up Fuel Bundle Competition, being a society lottery conducted under the registered scheme of the Beneficiary, as described in these Terms and Conditions. "Competition Period" - The period commencing on 1 July 2026 and ending on 30 September 2026 (the "Closing Date"). "Draw Date" - 1 October 2026, being the date on which the winning ticket will be selected. "Entrant" or "Participant" - Any natural person who purchases a valid Ticket and thereby enters the Competition in accordance with these Terms and Conditions. "HBUFC" - Hout Bay United Football Community, as aforesaid. "Organiser" or "Promoter" - Step-Up, the duly appointed Society Lottery Manager and Promoter, operating from 6 Riverside Terrace, Hout Bay, Cape Town, 7806, email: [email protected], website: www.step-up.africa. "POPIA" - The Protection of Personal Information Act 4 of 2013, as amended. "Prize" - The Step-Up Fuel Voucher to the value of R100,000.00 (one hundred thousand rand), as further described in clause 9. "Registered Scheme" - The society lottery scheme registered by the Commission in favour of the Beneficiary under NLC registration number 00268/01. "Ticket" - A valid, uniquely numbered digital or physical entry ticket sold at R10.00 (ten rand) per ticket for the Competition. "Winner" - The Entrant whose Ticket number is selected in the random electronic draw conducted on the Draw Date. "Working Day" - Any day other than a Saturday, Sunday, or public holiday. 1.2 In these Terms and Conditions: - headings are for convenience only and shall not affect interpretation; - words in the singular include the plural and vice versa; - any reference to a natural person includes a juristic person and vice versa; - a reference to legislation includes all amendments and subordinate legislation made thereunder; - if any provision is unlawful or unenforceable, it shall be severed without affecting the remaining provisions. 2. ORGANISER AND REGISTERED SOCIETY 2.1 The Competition is promoted by Step-Up (the "Organiser" or "Promoter") on behalf of Hout Bay United Football Community (NPO #165 406), a society duly registered with the National Lotteries Commission under the Act. 2.2 The Beneficiary holds a valid society registration with the NLC (registration number 00268/01). The Registered Scheme under which this Competition is conducted has been duly approved by the Commission. 2.3 The Organiser's contact details are: Step-Up, 6 Riverside Terrace, Hout Bay, Cape Town, 7806; email: [email protected]; website: www.step-up.africa. 3. LEGAL BASIS AND REGULATORY COMPLIANCE 3.1 This Competition constitutes a society lottery conducted in terms of Chapter 3 of the Act and the regulations promulgated thereunder. 3.2 The promotion, administration, and conduct of this Competition is subject to the terms of the Registered Scheme as approved by the Commission. Any material modification to the scheme requires prior written approval from the Commission. 3.3 Participation in this Competition is voluntary and constitutes acceptance by the Entrant of these Terms and Conditions in their entirety. No person is obliged to purchase a Ticket. 3.4 These Terms and Conditions are to be read in conjunction with the Act and any applicable regulations. In the event of any conflict between these Terms and Conditions and the Act or applicable regulations, the Act and regulations shall prevail. 3.5 The Consumer Protection Act 68 of 2008 ("CPA") applies to this Competition to the extent required by law. Nothing in these Terms and Conditions shall be construed as limiting or excluding any rights that an Entrant may have under the CPA. 4. ELIGIBILITY TO PARTICIPATE 4.1 Participation in this Competition is open to natural persons who: - are 18 (eighteen) years of age or older at the time of ticket purchase; - are ordinarily resident in the Republic of South Africa; - are in possession of a valid South African identity document, passport, or other lawful proof of identity; and - purchase a valid Ticket in accordance with these Terms and Conditions. 4.2 The following persons are NOT eligible to participate and are expressly excluded: - persons under the age of 18 (eighteen) years; - persons who are not ordinarily resident in the Republic of South Africa; - any director, member, partner, employee, agent, or consultant of the Organiser, the Beneficiary, or any person involved in the creation, administration, or management of the Competition or the Registered Scheme; - the immediate family members (spouse, life partner, parent, child, or sibling) of any person referred to above; - any person acting as a ticket agent or reseller unless duly authorised in writing by the Organiser; - any person who has obtained Tickets by fraudulent, unlawful, or improper means. 4.3 The Organiser reserves the right to verify the eligibility of any Entrant at any stage of the Competition. Where an Entrant is found to be ineligible, their entry will be void and any prize awarded will be forfeited. 4.4 By participating, each Entrant warrants and represents that they meet all eligibility requirements set out in clause 4.1 above. 5. COMPETITION PERIOD AND KEY DATES - Tickets on sale (Opening Date): 1 July 2026 - Closing Date (last day for ticket sales): 30 September 2026 at 23:59 (South African Standard Time) - Draw Date: 1 October 2026 (livestreamed from Cape Town, South Africa) - Prize claim deadline: 90 days from date of notification to the Winner 5.2 The Organiser reserves the right to extend or curtail the Competition Period with prior written approval from the Commission where required by the Act. Any such change will be communicated to Entrants via the official website (www.step-up.africa) and the Organiser's social media platforms. 5.3 No Tickets may be purchased or entered after the Closing Date. Any Ticket purchased after the Closing Date shall be void and the purchase price will be refunded. 6. TICKETS AND ENTRY 6.1 The price of each Ticket is R10.00 (ten rand) per Ticket, inclusive of VAT where applicable. 6.2 The maximum number of Tickets available for sale is 100,000 (one hundred thousand). The total face value of all Tickets is R1,000,000.00 (one million rand). 6.3 There is no limit on the number of Tickets that a single Entrant may purchase, subject to availability and the maximum ticket cap in clause 6.2. 6.4 Each Ticket bears a unique ticket number, which serves as the Entrant's entry number for the draw. No Entrant may alter, copy, or duplicate a Ticket. Tampered or fraudulent Tickets are void. 6.5 Each Ticket shall contain or reflect the following information, as required by the Act: - the unique ticket number; - the name of the Competition; - the ticket price (R10.00); - the full name of the Beneficiary society (Hout Bay United Football Community); - the Promoter's name and address (Step-Up, 6 Riverside Terrace, Hout Bay, Cape Town, 7806); - the Closing Date (30 September 2026); - the Draw Date and place of the draw (1 October 2026, livestreamed from Cape Town, South Africa); - a statement that the society is registered with the National Lotteries Commission (NLC Reg. No. 00268/01). 6.6 Tickets are sold via the Organiser's official digital platform and any other distribution channel duly authorised by the Organiser. The Organiser accepts no responsibility for Tickets purchased through unauthorised third-party channels. 6.7 All ticket sales are final. Save as expressly provided in these Terms and Conditions (including clause 5.3 above), no refunds will be given once a Ticket has been purchased. 6.8 Unsold Tickets will be voided prior to the draw and will be excluded from participation in the draw. The draw will be conducted only from the pool of validly sold Tickets. 7. DRAW PROCEDURE 7.1 The draw will take place on the Draw Date (1 October 2026) in Cape Town, South Africa, by means of a random electronic draw process. 7.2 The draw will be livestreamed in real time on the Organiser's official social media channels to ensure transparency and public verifiability. 7.3 The winning Ticket will be selected at random from all validly sold, non-voided Tickets using a certified electronic draw machine or equivalent randomisation system. The draw process is designed to ensure that each sold Ticket has an equal and random probability of being selected. 7.4 The draw will be conducted in the presence of an independent representative or other oversight mechanism as may be required by the Commission or as the Organiser deems appropriate to ensure the integrity of the process. 7.5 The outcome of the draw is final and binding. No correspondence will be entered into regarding the draw outcome. 7.6 In the event that the Draw Date cannot proceed as scheduled due to circumstances beyond the Organiser's reasonable control (force majeure), the Organiser will reschedule the draw to the next practicable date and will notify Entrants accordingly via the official website and social media platforms. 8. WINNER NOTIFICATION AND VERIFICATION 8.1 The Winner will be notified within 5 (five) Working Days of the Draw Date by: - direct email to the email address registered at the time of ticket purchase; and - telephone call to the contact number registered at the time of ticket purchase. 8.2 The Winner's name and ticket number will also be published on the Organiser's official website (www.step-up.africa) and social media platforms (Instagram, Facebook, and TikTok). 8.3 Participants may obtain information regarding the lottery outcome by contacting the Organiser via email at [email protected] or by telephone during normal business hours. 8.4 Before any Prize is awarded, the Winner must: - produce valid South African identity documentation (identity document, passport, or other lawful proof of identity acceptable to the Organiser); - produce the original winning Ticket or provide the unique winning ticket reference number; - confirm their South African residency status; - confirm eligibility in terms of clause 4.1 of these Terms and Conditions; and - complete any additional verification or documentation reasonably required by the Organiser. 8.5 If the Winner cannot be contacted within 14 (fourteen) days of the first notification attempt, or fails to satisfactorily complete the verification process set out in clause 8.4 within that period, the Organiser reserves the right to disqualify that Winner and to conduct a redraw to select an alternative winner, subject to Commission approval where required. 9. PRIZE 9.1 There is one (1) Prize for this Competition, being: - A Step-Up Fuel Voucher to the value of R100,000.00 (one hundred thousand rand). 9.2 The Prize is non-transferable and may not be exchanged for cash or any other alternative, except at the sole discretion of the Organiser. 9.3 The Prize is subject to availability. In the event that the specific Prize becomes unavailable for reasons beyond the Organiser's control, the Organiser reserves the right to substitute a prize of equal or greater value, subject to prior approval from the Commission where required. 9.4 The Prize will be fulfilled as follows: - physical prizes may be collected at the Organiser's offices at 6 Riverside Terrace, Hout Bay, Cape Town, 7806, or delivered to the Winner after verification, at the Organiser's discretion; and - any applicable digital or voucher-based prizes will be delivered to the Winner electronically after successful verification. 9.5 The Winner is responsible for any tax implications arising from receipt of the Prize. The Organiser makes no representations as to the tax treatment of the Prize and recommends that the Winner seek independent financial advice in this regard. As at the date of these Terms and Conditions, lottery prizes in South Africa are generally not subject to income tax or capital gains tax in the hands of the Winner; however, the Winner is advised to confirm the applicable tax position with their own advisors. 9.6 The Commission may, in terms of the Act, require the Organiser or the Beneficiary to provide security or a guarantee that the Prize is available prior to the draw. 10. UNCLAIMED PRIZES 10.1 A Prize will be deemed unclaimed if the Winner: - cannot be contacted within 14 (fourteen) days of the first notification attempt; or - fails to claim the Prize within 90 (ninety) days of the date of the notification to the Winner; or - fails to satisfactorily complete the verification process set out in clause 8.4. 10.2 Any Prize that remains unclaimed after the expiry of the 90-day claim period will be forfeited and will either be: - donated to the Beneficiary (HBUFC) for application towards its charitable, sporting, developmental, and community upliftment objectives; or - applied towards future promotional activities of the Organiser or the Beneficiary, at the Organiser's discretion and subject to any applicable requirements of the Commission. 11. DISQUALIFICATION 11.1 The Organiser reserves the right to disqualify any Entrant and to void any Ticket, without prior notice, in the event of: - any breach of these Terms and Conditions by the Entrant; - the provision of false, inaccurate, or misleading information by the Entrant; - any fraud, dishonesty, tampering, or manipulation of the Competition or any ticket; - ineligibility of the Entrant in terms of clause 4; - purchase of a Ticket by or on behalf of a person under the age of 18 years; - any attempt to gain unfair advantage in the Competition; or - any conduct that is contrary to applicable law, including the Act. 11.2 Where an Entrant is disqualified after being announced as a Winner, the Prize will be forfeited. The Organiser may, at its discretion and subject to Commission approval where required, conduct a redraw. Any such redraw shall be conducted exclusively from the pool of remaining valid, sold Tickets that were not voided, disqualified, or otherwise excluded. The disqualified Ticket shall be permanently excluded from the redraw and from all further participation in the Competition. 12. USE OF LOTTERY PROCEEDS 12.1 The net proceeds of this Competition (i.e. gross ticket sales revenue less total expenses as disclosed in the approved scheme) are intended to be applied exclusively towards the charitable, sporting, developmental, and community upliftment objects of HBUFC, as follows (based on full ticket sales): - Gross ticket revenue: R1,000,000.00 - Less: Prize (Fuel Voucher + promo prize): (R100,000.00) - Less: Marketing & promotional costs: (R150,000.00) - Less: Production & operational costs: (R30,000.00) - Less: Society Lottery Manager fee (15%): (R108,000.00) - Estimated net proceeds to HBUFC: R612,000.00 12.2 The net proceeds allocated to HBUFC will be applied towards: - accommodation costs for players and youth participants (R124,000); - football syllabus and coaching programmes (R150,000); - education initiatives (R135,600); - nutrition support for players (R148,800); - training and match kit (R53,600). 12.3 The above figures are based on full ticket sales (100,000 tickets). Actual amounts will be proportionate to actual ticket sales achieved. 12.4 The Organiser confirms that all proceeds will be used exclusively for the purposes stated in the Registered Scheme and as required by the Act. The Beneficiary and the Organiser undertake to maintain accurate accounting records in respect of all income and expenditure relating to the Competition. 13. PROTECTION OF PERSONAL INFORMATION 13.1 The Organiser processes personal information of Entrants as a responsible party in terms of POPIA. 13.2 By purchasing a Ticket and participating in the Competition, each Entrant consents to the Organiser collecting, storing, using, and processing their personal information for the following purposes: - processing ticket purchases and administering the Competition; - verifying the identity and eligibility of Entrants and the Winner; - notifying the Winner and facilitating Prize fulfilment; - publishing the Winner's name on the official website and social media platforms for Competition transparency purposes (limited to name and ticket number - no identity numbers or sensitive personal information will be published); - complying with legal obligations under the Act, POPIA, and other applicable legislation; and - communicating with Entrants regarding the Competition. 13.3 The Organiser will not sell, rent, or otherwise disclose personal information to third parties for marketing purposes without the Entrant's prior consent, except as required by law. 13.4 The Organiser will implement reasonable technical and organisational measures to protect personal information against unauthorised access, loss, or destruction, in accordance with POPIA. 13.5 Entrants have the right to: - request access to their personal information held by the Organiser; - request correction of inaccurate personal information; - request deletion of personal information (subject to applicable legal retention requirements); and - lodge a complaint with the Information Regulator (South Africa) at [email protected]. 13.6 For privacy enquiries, Entrants may contact the Organiser at [email protected]. 14. LIMITATION OF LIABILITY 14.1 The Organiser, the Beneficiary, and their respective directors, officers, employees, and agents shall not be liable for: - any loss or damage suffered by an Entrant arising from their participation in the Competition, save where such loss or damage is caused by the gross negligence or wilful misconduct of the Organiser; - any failure of technology, communication networks, or third-party platforms that may prevent an Entrant from purchasing a Ticket or accessing Competition information; - any unauthorised access to, or alteration of, Ticket data due to circumstances beyond the Organiser's reasonable control; - any loss arising from incorrect contact details provided by an Entrant resulting in non-delivery of notifications; or - any indirect, consequential, or special loss or damage. 14.2 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation, or as otherwise required by applicable law including the CPA. 14.3 The Organiser makes no representation that the Prize will meet the Winner's individual requirements or expectations beyond the description provided in clause 9.1. 15. PAYMENT VALIDITY AND FAILED TRANSACTIONS 15.1 A Ticket shall only be deemed valid and an entry into the Competition shall only be confirmed once payment for that Ticket has been successfully authorised, processed, and received in cleared funds by the Organiser. 15.2 In the event of a failed, declined, reversed, or charged-back payment for any reason (including but not limited to insufficient funds, card reversal, EFT reversal, payment gateway failure, or fraudulent payment), the relevant Ticket shall be automatically void and the purported entry shall be of no force or effect. The Organiser accepts no liability for any loss suffered as a result of a failed transaction. 15.3 Where a payment is reversed or charged back after the draw has taken place and the relevant Ticket has been selected as the winning Ticket, the Organiser reserves the right to disqualify that Ticket and void the Prize award, pending investigation and resolution of the payment failure. In such circumstances the Organiser may conduct a redraw in accordance with clause 11.2. 15.4 The Organiser reserves the right to withhold Prize fulfilment pending confirmation of cleared payment in respect of the winning Ticket. 15.5 All payment processing is subject to the terms and conditions of the relevant payment service provider. The Organiser is not responsible for any fees, charges, or deductions imposed by a payment service provider. 16. FRAUD, SUSPICIOUS TRANSACTIONS, AND COMPLIANCE 16.1 The Organiser is committed to the lawful and transparent operation of this Competition and reserves the right to refuse, void, suspend, or further investigate any transaction, Ticket purchase, or entry that the Organiser reasonably suspects involves or arises from: - fraud, misrepresentation, or identity manipulation; - money laundering, structuring, or any activity that may constitute an offence under the Financial Intelligence Centre Act 38 of 2001 ("FICA") or the Prevention of Organised Crime Act 121 of 1998 ("POCA"); - payment abuse, including the use of stolen, cloned, or unauthorised payment credentials; - the use of automated systems, bots, scripts, or other technological means to obtain an unfair advantage or to circumvent these Terms and Conditions; or - any other unlawful, improper, or suspicious conduct. 16.2 Where a transaction or entry is voided pursuant to clause 16.1, the Organiser shall not be obliged to refund the purchase price unless required to do so by applicable law. The Organiser may refer suspicious transactions to the relevant authorities, including the Financial Intelligence Centre, the South African Police Service, or any other competent authority. 16.3 The Organiser reserves the right to request additional verification documentation from any Entrant where it has reasonable grounds to do so, and to withhold Prize fulfilment pending satisfactory completion of such verification. 17. PROHIBITION ON RESELLING, SYNDICATES, AND COMMERCIAL REDISTRIBUTION 17.1 Tickets are sold for personal, non-commercial use only. The following conduct is strictly prohibited without the prior written consent of the Organiser: - the resale, on-selling, or transfer of Tickets to any third party for consideration, whether at face value, at a premium, or otherwise; - the formation of ticket syndicates, pooling arrangements, or any collective purchasing scheme intended to circumvent the individual entry structure of the Competition; - the commercial redistribution, bulk purchase for resale, or distribution of Tickets through any unauthorised channel or platform; and - the advertising, listing, or offering of Tickets for sale on any secondary market, online marketplace, social media platform, or auction platform. 17.2 Any Ticket obtained through resale, syndication, or commercial redistribution in contravention of clause 17.1 shall be void and the purported holder of such Ticket shall not be entitled to participate in the draw or claim any Prize. 17.3 The Organiser reserves the right to take legal action against any person who engages in unauthorised reselling, syndication, or commercial redistribution of Tickets, including seeking damages and an interdict. 17.4 Authorised ticket agents or resellers may only operate with the express prior written consent of the Organiser and must comply with all applicable provisions of the Act and these Terms and Conditions. 18. AUDIT AND RECORD-KEEPING 18.1 The Organiser and the Beneficiary shall each maintain complete, accurate, and up-to-date records in respect of the Competition, including: - all ticket sale records, including ticket numbers issued, sale dates, and purchase prices received; - all financial records reflecting gross revenue, expenses incurred, and net proceeds allocated to the Beneficiary; - all draw records, including the draw methodology, the identity of any independent oversight representative present, and the outcome of the draw; - all prize fulfilment records, including the identity of the Winner, verification documentation, and confirmation of prize delivery; and - all records relating to voided, disqualified, or unclaimed Tickets and prizes. 18.2 The Organiser and the Beneficiary shall retain all records referred to in clause 18.1 for a minimum period of five (5) years from the conclusion of the Competition, or such longer period as may be required by applicable law or as directed by the Commission. 18.3 The Organiser and the Beneficiary shall make all records referred to in clause 18.1 available to the National Lotteries Commission upon lawful request, in accordance with the Act and any applicable regulations. 18.4 The Organiser shall, within the period prescribed by the Act or by the Commission, submit to the Commission a return or report in respect of the Competition in the prescribed form and containing the prescribed information. 18.5 The Organiser and Beneficiary consent to the Commission conducting any audit, inspection, or investigation in respect of the Competition as the Commission is entitled to do in terms of the Act. 19. GENERAL PROVISIONS 19.1 These Terms and Conditions constitute the entire agreement between the Organiser and each Entrant relating to the Competition and supersede all prior representations, arrangements, and agreements. 19.2 The Organiser reserves the right to amend these Terms and Conditions at any time with prior written approval from the Commission where required by the Act. Any such amendment will be published on the official website (www.step-up.africa). 19.3 The Organiser reserves the right to cancel, suspend, or modify the Competition at any time, with Commission approval where required, in the event of circumstances beyond the Organiser's reasonable control or where the integrity of the Competition is compromised. 19.4 Any failure by the Organiser to enforce any provision of these Terms and Conditions shall not constitute a waiver of that provision. 19.5 These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms and Conditions or the Competition shall be subject to the exclusive jurisdiction of the South African courts. 19.6 No modification to the Registered Scheme, including any change to the Competition Period, ticket price, prize, or maximum number of tickets, shall be made without the prior written approval of the Commission. 19.7 In the event of any dispute regarding the interpretation of these Terms and Conditions, or the conduct of the Competition, the decision of the Organiser shall be final and binding, save as otherwise required by law. 19.8 Entrants may not cede, assign, or otherwise transfer any rights or obligations arising from their participation in the Competition. 20.
